These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Mirrorly Inc. ("Company," "we," "us," or "our"). By accessing, browsing, or using the Mirrorly website (www.mirrorly.com), the Mirrorly mobile application, or the Mirrorly smart mirror hardware, you agree to be bound by these Terms. If you do not agree to these Terms in their entirety, you are prohibited from using the Services.

Order Process: All purchases of Mirrorly hardware are subject to availability. You agree to provide accurate, current, and complete information during the checkout process. You authorize us to charge the selected payment method for the amount of your order and any applicable taxes.

Pricing Accuracy: We strive to ensure the accuracy of prices displayed on our website. However, we reserve the right to correct errors, inaccuracies, or omissions, and to change or update information at any time without prior notice.

Cancellation Policy: Orders for physical hardware can be cancelled within 24 hours of placement. After this period, the order will be processed for manufacturing and shipping. Refunds for cancelled orders will be issued to the original payment method once the return process is initiated.

Free Trial: New subscribers are eligible for a 14-day free trial of the Mirrorly Premium subscription (including AI Skin Analysis and Routine Tracking). To avoid charges, you must cancel your subscription before the trial period expires.

Billing Cycle: Subscriptions are billed on a monthly or annual basis, depending on the plan selected. Annual plans offer a discounted rate equivalent to two months free.

Auto-Renewal: Your subscription will automatically renew for successive periods unless you cancel the subscription at least 24 hours before the end of the current period. You may cancel your subscription at any time in the Mirrorly app under "Settings" > "Subscription."

You agree to use the Mirrorly App and Device solely for personal, non-commercial purposes. You may not:

• Access or attempt to access any other accounts, systems, or data without authorization;
• Interfere with or disrupt the operation of the Services or servers/networks connected to the Services;
• Use the AI analysis features to generate content that violates our Community Guidelines or applicable laws;
• Reverse engineer, decompile, or disassemble any software associated with the Services.

Mirrorly Inc. owns all right, title, and interest in and to the Mirrorly brand, trademarks, logos, service marks, trade names, trade dress, and all related intellectual property rights. The Mirrorly software, including the proprietary AI skin analysis algorithms, is licensed to you as described in these Terms. You are granted a limited, non-exclusive, non-transferable license to use the software solely for your personal use in connection with the Mirrorly hardware.

Mirrorly warrants that the hardware (mirrors, stands, and accessories) will be free from defects in materials and workmanship under normal use for a period of two (2) years from the date of purchase. This warranty does not cover damage caused by accident, misuse, modification, or failure to follow operating instructions.

In no event shall Mirrorly Inc., its directors, officers, employees, affiliates, agents, contractors, or licensors, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in San Francisco, California. You and Mirrorly agree to waive any right to a trial by jury and to bring any claim only on an individual basis.
